1. About Nelamy

Nelamy is an online marketplace that enables buyers and sellers to list, advertise, auction, buy, and sell products and services.

Nelamy is only a technology platform. Nelamy is not the owner, importer, exporter, manufacturer, distributor, retailer, supplier, warehouse operator, or reseller of products listed by users. All listings are created and managed solely by the respective sellers.

2. Eligibility

You must:

• Be at least 18 years of age, or
• Use the Platform under the supervision of a parent or legal guardian.

You agree that all information you provide is accurate, complete, and current.

3. User Accounts

You are responsible for:

• Maintaining the confidentiality of your account.
• Your password.
• All activities conducted using your account.

Nelamy reserves the right to suspend or permanently terminate any account without prior notice where misuse, fraud, suspicious activity, or violation of these Terms is detected.

4. Marketplace Disclaimer

Nelamy acts solely as a marketplace connecting buyers and sellers. We do not own, inspect, verify, test, certify, endorse, or guarantee any product or service listed on the Platform.

We do not guarantee:

• Authenticity
• Originality
• Quality
• Safety
• Performance
• Legality
• Merchantability
• Fitness for any purpose
• Condition
• Availability
• Delivery
• Accuracy of descriptions
• Warranty

All transactions are entered into directly between buyers and sellers.

5. No Liability for Products

Nelamy shall not be responsible or liable for:

• Counterfeit products
• Fake products
• Damaged products
• Used products
• Defective products
• Illegal products
• Missing items
• Incorrect descriptions
• Incorrect images
• Manufacturing defects
• Quality issues
• Warranty claims
• Expired products
• Product recalls
• Injuries
• Death
• Losses
• Damages
• Financial losses
• Business losses
• Consequential damages
• Shipping damages
• Customs issues
• Import/export restrictions
• Intellectual property disputes

The buyer purchases products entirely at their own discretion and risk.

6. Auctions

By placing a bid you confirm that:

• Your bid is genuine.
• You have sufficient funds.
• You intend to complete the purchase if you win.

Fake bidding, bid manipulation, or collusive bidding is strictly prohibited. Nelamy reserves the right to cancel auctions suspected of fraudulent activity.

7. Buy Now Purchases

Where "Buy Now" is available, the first confirmed purchase shall secure the item. Completion of payment does not automatically guarantee delivery, as the transaction remains subject to seller performance and any applicable verification or legal requirements.

8. Seller Responsibilities

Sellers are solely responsible for:

• Product ownership.
• Product legality.
• Product quality.
• Product authenticity.
• Product descriptions.
• Product photographs.
• Pricing.
• Inventory.
• Shipping.
• Packaging.
• Delivery.
• Taxes.
• Compliance with Pakistani law.

The seller indemnifies Nelamy against any claims arising from their listings or transactions.

9. Buyer Responsibilities

Buyers are responsible for:

• Reviewing listings carefully.
• Asking questions before bidding or purchasing.
• Verifying product suitability.
• Completing payments.
• Complying with applicable laws.

10. Prohibited Items

Users may not list or sell items prohibited under the laws of Pakistan or by Nelamy's policies, including but not limited to:

• Illegal drugs
• Narcotics
• Firearms
• Ammunition
• Explosives
• Counterfeit goods
• Stolen property
• Human organs
• Pornographic material
• Wildlife products prohibited by law
• Fake currency
• Government documents
• Dangerous chemicals
• Hacking devices
• Malware
• Illegal software
• Items that infringe intellectual property rights

Nelamy reserves the right to remove any listing at its sole discretion.

11. Payments

Nelamy may facilitate payment processing through third-party providers. Nelamy is not a bank, financial institution, or payment processor and is not responsible for payment delays, failed transactions, chargebacks, banking errors, or third-party payment provider issues.

12. Shipping

Shipping arrangements are the sole responsibility of buyers and sellers unless expressly stated otherwise. Nelamy is not responsible for:

• Courier delays
• Lost shipments
• Damaged shipments
• Customs clearance
• Delivery failures

13. Returns & Refunds

Nelamy does not guarantee refunds or returns. Refunds and returns remain subject to the seller's stated policy and applicable law. Nelamy may assist in facilitating communication but is not obligated to resolve disputes or provide compensation.

14. Intellectual Property

All trademarks, logos, graphics, software, and content belonging to Nelamy remain the exclusive property of Nelamy unless otherwise stated. Users may not reproduce, modify, distribute, or exploit Nelamy's intellectual property without prior written consent.

15. User Content

By uploading listings, images, videos, descriptions, or other content, you confirm that:

• You own the rights to the content or have permission to use it.
• Your content does not violate any law or third-party rights.

You grant Nelamy a non-exclusive, worldwide, royalty-free licence to display, reproduce, and promote your content for the operation and marketing of the Platform.

16. Limitation of Liability

To the maximum extent permitted by law, Nelamy, its owners, directors, employees, affiliates, agents, partners, licensors, and service providers shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, punitive, or economic damages arising from:

• Use of the Platform
• Products
• Services
• Listings
• Auctions
• Payments
• Deliveries
• Communications between users
• Technical failures
• Data loss
• Viruses
• Unauthorized access
• Business interruption
• Loss of profits
• Loss of goodwill

Your use of the Platform is entirely at your own risk.

17. Indemnity

You agree to defend, indemnify, and hold harmless Nelamy, its owners, employees, affiliates, and partners from any claims, damages, liabilities, costs, losses, penalties, or legal expenses arising out of your use of the Platform, your listings, your transactions, or your breach of these Terms.

18. Termination

Nelamy may suspend or terminate any account, listing, or access to the Platform at any time, with or without notice, where we believe these Terms have been violated or where required for legal, security, or operational reasons.

19. Privacy

Your use of the Platform is also governed by our Privacy Policy, which forms part of these Terms.

20. Modifications

Nelamy reserves the right to amend these Terms at any time. Updated Terms will be published on the Platform and become effective upon publication. Continued use of the Platform constitutes acceptance of the revised Terms.

21. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of Islamabad, Pakistan, unless otherwise required by applicable law.
